Dec 19 (Reuters) - Cigarette smoking among American teenagers dropped to a record low in 2012, a decline that may have been partly driven by a sharp hike in the federal tobacco tax, researchers said on Wednesday.

An annual survey of about 45,000 students in the eighth, 10th and 12th grades found that the overall proportion of those saying they had smoked in the prior 30 days fell by just over a percentage point to 10.6 percent.

"A one percentage point decline may not sound like a lot, but it represents about a 9 percent reduction in a single year in the number of teens currently smoking," Lloyd Johnston, the principal investigator in the study, said in a statement.

He said reductions on that scale can translate into the prevention of thousands of premature deaths and tens of thousands of cases of cancer and other serious disease.

More than 400,000 Americans are estimated to die prematurely each year as a result of cigarette smoking - the No. 1 cause of preventable U.S. deaths - and most smokers begin their habit as adolescents, experts say.

Healthcare advocates hailed Wednesday's findings as evidence that higher cigarette taxes were paying off, combined with federal curbs on youth-oriented tobacco marketing and sales and a sweeping anti-smoking media campaign.

The researchers also cited the increase in federal cigarette taxes, raised by 62 cents a pack in 2009, as a likely contributing factor. The findings were part of an annual survey by University of Michigan researchers released by the National Institute on Drug Abuse.

Smoking rates fell for each of the individual age groups surveyed, most notably among eighth graders - from 6.1 percent in 2011 to 4.9 percent in 2012, the survey found.

Longer-term trends showed teen smoking rates dropping by about three-fourths among eighth graders, two-thirds among 10th graders and by half among 12th graders since a peak in the mid-1990s, researchers said.

One reason cited by experts is that the proportion of students who have ever tried smoking has declined sharply. Whereas nearly half of all eighth graders had tried cigarettes in 1996, just 16 percent had done so this year.

Teen attitudes toward smoking also continued to become more negative. For example, 80 percent of teens said they preferred to date nonsmokers in 2012.

But anti-tobacco advocates said their battle to stamp out teen smoking was far from over, noting that 17 percent of high school seniors still graduate as smokers.

Researchers singled out concerns over new forms of smokeless tobacco, including dissolvable products like Camel-branded "Orbs" and "Strips," and a fine, moist form of snuff called snus (rhymes with "loose"), which users place under their upper lip.

They said a significant portion of older teens have experimented with small cigars and water pipes called hookahs, which are becoming popular among young adults.

"We cannot let our guard down when the tobacco industry still spends $8.5 billion a year - nearly $1 million ever hour - to market its deadly and addictive products and is pushing new products ... that entice youth," said Susan Liss, executive director for the Campaign for Tobacco-Free Kids. Objective

The objective of this survey was to understand the experience that tobacco smokers have with electronic cigarettes and to explore their effects. Specifically, find answers to the following questions:

• Do smokers that try this smokeless product continue to use it?
• Do those who make the switch to e-cigarettes feel better and save money?
• Do friends and family support a smoker's switch to such devices?
• Why do smokers not continue to use e-cigarettes after trying them?
• Can e-cigarettes help smokers quit smoking?

Methodology

An anonymous online survey was sent to an audience that previously interacted with the electronic cigarette review website eCigarettes365.com in 3 different ways:

1. Subscribed to the newsletter.
2. Posted a product review or commented on a review.
3. Send an inquiry to eCigarettes365.com through the online contact form.

A link to the survey was also posted on the company's Facebook, Google+ and Twitter page.

165 people started the survey and 162 completed it.

It is important to note that this survey was not conducted by a company/website that sells any e-cigarettes or related products. eCigarettes365.com is an informational website providing consumer reviews and buying guidance to its visitors.

Findings

The gender ratio of the participants was well balanced with 52.7% female and 47.3% male. The participants' age distribution was as follows:

It is good to see that nobody in this audience was less than 18 years of age.

More than 72% of participants have been smoking tobacco cigarette or smoked them for over 15 years. This is not surprising considering that more than 73% of the participants were over 40 years of age.

Assuming that all participants had purchased e-cigarettes in the past the next question assessed the current "smoking" habit.

Only about 13% of all participants reverted back to traditional tobacco cigarettes whereas 55% only use e-cigarettes. It was somewhat surprising to see that 26.8% now use traditional cigarettes and e-cigarettes. It is great to see that 5.5% quit smoking altogether.

All the subsequent survey questions asked did depend on the participant's current "smoking" habit.

Participants now only smoking tobacco cigarettes

These participants did not successfully switch to e-cigarettes and reverted back to smoking traditional tobacco cigarettes. The majority of this group used their e-cigarette for less than 6 months.

To find out why this group discontinued "vaping" a multiple choice question was posed.

The results indicate that e-cigarettes primarily did not satisfy the user's cravings and habits but product issues and cost were key factors as well.

Participants now only using e-cigarettes

About 82% of this group that actually made the switch from tobacco cigarettes to e-cigarettes has been using the device for more than 6 months. This is a very long time for smokers and is very encouraging number.

The effects of electronic cigarettes on how people feel, their financial benefits, and social acceptance are overwhelmingly positive.

Over 92% agree that they feel better. Not even one participant disagreed with the statements "I feel better" as an effect of using electronic cigarettes.

76% stated that the device saves them money. It is fair to assume that this is due to the fact that refill cartridges for e-cigarettes and cheaper than packs of traditional tobacco cigarettes (see Savings Calculator).

A whopping 94% of e-cigarette users find that their friends and family support their switch to e-cigarettes. Only about 2% did not seem to have this kind of support.

Participants now smoking tobacco cigarettes and using e-cigarettes

This group of participants did not manage to completely leave tobacco cigarettes behind. But they alternate between traditional and electronic cigarettes and about 60% have been doing so for more than 6 months.

A large majority of this group also finds positive effects of using an electronic cigarette on how they feel, their savings, and social support.

74% agree that they feel better, 81% of this group have the support from friends and family when "vaping", and 75% find that using the product is cheaper than smoking tobacco cigarette.

Participants that quit smoking

Without any doubt quitting smoking (tobacco and e-cigarettes) is the best solution for health and wallet. Only about 5.5% of all participants quit smoking but 55.6% of those strongly agree that the e-cigarette helped them quit. However, the group here is divided with 44% not giving any credit to e-cigarettes when quitting.

Conclusion

This survey clearly shows that a large majority of electronic cigarette users feel better, have the support of their friends and family, and that the product saves them money. These are overwhelmingly positive results that position e-cigarettes as a solid alternative to tobacco cigarettes.

In fiction there was Roy Hobbs, the athletic prodigy who came, unheard of, out of the Iowa cornfields to take the world by storm. In real life there is Mike Trout, the wunderkind from New Jersey—a real-life Roy Hobbs, who does it all and has become an MVP candidate at the age of 21. In beverages, there are energy drinks, the once-upon-a-niche segment that has morphed into a $1.5 billion monster—and expected to reach $2 billion in annual retail sales by 2016.

And now, add electronic cigarettes to that list.

Started as an Internet phenomenon, e-cigs have their roots in China and first made their way to this side of the world in the mid-1990s. Still a niche product at retail, the promise of future fortune has industry experts and convenience retailers alike buzzing about the category’s potential.

“It’s a fairly new category, and that’s what I find so exciting,” said Bonnie Herzog, senior market analyst at Wells Fargo. “I’m making some pretty big predictions. I think it’s possible that consumption of e-cigarettes could surpass that of traditional cigarettes within the next decade.”

Herzog likens e-cigs to energy drinks in terms of growth, profit potential…and buzz.

“Remember when energy drinks first hit the market?” she continued. “People were saying, ‘Is it a fad, or is it a trend? What’s going on?’ I do think there are some similarities here.”

Like energy drinks a decade ago, e-cigarettes is a category in its retail infancy. According to Wells Fargo, e-cigarettes currently generate roughly $300 million at retail. But like energy drinks, that number is expected to grow exponentially—developing into a $1 billion category and offering gross margins comparable to traditional cigarettes, within a decade.

Some industry insiders, including Tom Kiklas, co-founder and spokesman for the Tobacco Vapor Electronic Cigarette Association (TVECA), expect the $1 billion barrier to be cracked in less than half that time. According to Kiklas, there are currently 1.5 million e-cigarette users. And while that number pales next to the 46 million Americans who consume traditional tobacco products, there is one key difference between the two segments: e-cigs are growing, while tobacco-based cigarettes are in decline.

“E-cigarettes are a very small category right now,” agreed Herzog. “But because the product’s attributes are so similar to traditional cigarettes, this makes them very attractive to existing smokers. The operative assumption is that the risk is reduced because you’re inhaling vapor. The notion that they offer the same sensation with less harm is an attractive proposition to a large group of consumers.”

‘New Age’ Tobacco
Indeed, e-cigs share two key attributes with the once burgeoning and now maturing New Age beverage category: added value in terms of perceived health benefits by consumers, and innovation by manufacturers. E-cigarette manufacturers are not allowed to make health claims. If they did so, they would be subject to much tighter FDA regulations. But word of mouth is perhaps the most powerful marketing tool ever devised, and many experts predict that individual states will soon be jumping into the act to pull in the reins on e-cigs—at least as it pertains to young-adult or even teenage consumption.

“There’s no question in my mind that you will see states putting restrictions on them—and rightly so, because they could be considered a gateway [to tobacco usage],” Herzog said. “The consumer right now is the traditional smoker.”

This dynamic is similar to what retailers have seen in beverages, where consumers have gravitated in large numbers toward those products that are perceived to be better for you (i.e. sugar-free, caffeine-free and fat-free products).

“Say your spouse doesn’t want you smoking,” Herzog said. “He or she doesn’t like the smell. Well, here; you can smoke this.”

The enormous appeal of e-cigarettes stems from a variety of perceived advantages over traditional cigarettes. Not only are they perceived as healthier, but also cheaper and far more convenient. They can be used almost anywhere because no smoke is inhaled or exhaled; only vapor.

“It was cool to be able to light up while walking through a Walmart,” said Mark Rivera, an e-cigarette consumer in Stratford, Conn., adding that “no-smoking” laws did not apply to e-cigs in his region.

Garnering Attention
And here’s another way that the e-cigarette category mirrors new age beverages: Once a few brands gained some legs in the marketplace, the big boys were quick to dive headlong into the water. Lorillard was the first in when the tobacco behemoth acquired all assets of blu e-cigarettes—one of the leading brands in the e-cig market—in a cash transaction this past spring. Wells Fargo predicts other major tobacco companies will likely follow Lorillard’s lead.

On the flip side of being a gateway into the tobacco category, there are consumers who use e-cigarettes as a smoking cessation tool.

“I absolutely think that people are using it that way,” noted Herzog. “But maybe they don’t quit. Maybe they enjoy it. I know many smokers who enjoy consuming tobacco, but they don’t like the risk. I think it’s going to evolve; I think you’re going to see it regulated and taxed. Only Minnesota has an OTP (other tobacco product) tax on it right now, but there’s no question in my mind that you will see states putting restrictions on them. But the consumer right now is the traditional smoker.”

Regulation Issues
Last April, the FDA announced its plans to regulate e-cigarettes as tobacco products and will work with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) to tax and regulate distribution, which means e-cigarette importers must have tobacco importing licenses, and sellers must have tobacco licenses in all 50 states.

States are still figuring out how to deal with e-cigarettes. In Hawaii, for example, the product was up against a proposal that aimed to tax e-cigarettes at 70% of the wholesale price. Luckily for Hawaiian retailers, the bill was not passed.

“We have no problem with the taxing of the product, but you have to tax it at the level of harm that it does, and it’s a less harmful product than a traditional tobacco cigarette,” Kiklas said. “So if you’re going to tax it, tax it at that level, and that level would be not very high.”

New Product Excitement
Tedeschi has been testing disposable and rechargeable e-cigarette brands at 15 of its 190 stores, and is also testing the refill cartridges.
“I don’t see the hype right now that seems to be prevalent in other parts of the country for e-cigarettes. It doesn’t seem to have reached New England yet, or at least the state of Massachusetts,” said Stephen Monaco, director of purchasing for Tedeschi Food Shops in Rockland, Mass. “But I believe electronic cigarettes and cigars are here to stay and will become more dominant as the year goes along.”

At Express Convenience Centers in Wisconsin, e-cigarette unit sales are low, but the company sees the sales and margins on electronic tobacco products as worth the investment, said Scott Glaser, merchandising manager and buyer for the 19-store chain.

“We do have a few committed e-cigarette customers, but it’s too soon to tell if customers are trading off from other tobacco categories or if they are capturing an entirely new customer,” Glaser said.

Faced with a $298 million budget deficit, Mayor Rahm Emanuel has pledged not to raise taxes on homes, gasoline or retail purchases. However, he has not ruled out a cigarette tax hike for the city of Chicago.

Chicago already has the second highest cigarette taxes in the country, second only to New York City. As of June, the average total cost of a pack of cigarettes in Illinois was $10.25, cheaper than only New York’s $12.50 per pack.

Cook County Board President Toni Preckwinkle proposed a plan Tuesday to raise the Cook County tax on smokes to $3 from $2. Faced with a large budget shortfall, Emanuel has not ruled out a similar increase for Chicago’s tax.

“If we do consider the cigarette tax, it has to invest in children’s health,” Emanuel said in a recent press conference about the proposed 2013 budget.

But a tax hike won’t necessarily mean more money for the city because many smokers have the option of driving across state lines to buy cheaper cigarettes. A pack in Wisconsin is about $7.98, which ranks it 11th in the nation. Indiana is 39th on the list at $5.56 a pack.

The Cook County Board acknowledges Chicago’s smokers may take their business elsewhere if the tax hike is passed. “As taxes go up, consumption goes down, especially for cigarettes,” said Cook County spokesman Owen Kilmer. “So we are actually expecting a revenue loss.”

In Chicago, the combined tax on a pack is currently $5.67, which comprises four different taxes. The federal tax is $1.01; Illinois tax is $1.98; Cook County collects $2; and the city of Chicago collects 68 cents.

Any increase would come at a time when cigarette sales are already down although tobacco companies are still managing to profit through other products. Reynolds American Inc. posted a nearly 7 percent profit increase in the third quarter Tuesday. The tobacco giant can thank e-cigarettes and smokeless tobacco products. The company performed slightly under analyst’s expectations and its stock price fell 58 cents to close at $41.94.

Reynolds American is the second largest tobacco company in the U.S. The maker of brands such as Camel, Pall Mall, and Winston posted $420 million in net income, or 74 cents per diluted share, a 6.6 percent increase from $394 million, or 67 cents per share, in the same period a year ago.

Total sales fell 3.7 percent, coming in at $2.1 billion from $2.2 billion in 2011. Sales of the company’s tobacco products, in particular, fell 6.1 percent from $1.89 billion to $1.77 billion. In the company’s conference call with analysts, Reynolds American CEO Daniel M. Delen blamed an “intensely competitive promotional environment.”

Bonnie Herzog, analyst at Wells Fargo Securities, estimated that underlying tobacco consumption during the quarter was down 3.5 percent. If Chicago taxes are hiked further, Kilmer expects cigarette sales here to decline even further.

But this does not mean that tobacco companies such as Reynolds American are in danger. Herzog cited the company for its innovation in smokeless tobacco and e-cigarette brands. “RAI has transformed itself into a comprehensive ‘total tobacco’ company, with leading brands and a solid strategy for long-term growth.”

However, the overall decline in cigarette consumption is not a short-term trend. Net sales for the last nine months decreased 3.6 percent from the same period a year ago, to $6.2 billion from $6.5 billion. Reynolds American posted $1.13 billion in net income for the last nine months, or 1.98 cents per diluted share, a 2.8 percent increase from the same period a year ago, which saw a net income of $1.1 billion and 1.88 cents per diluted share.

Tax hikes would only further this trend and result in lost revenue. But the health benefits exceed the costs, according to Kilmer, who cites a projected 7.2 percent decrease in youth smoking and the prevention of 18,400 children from becoming addicted to tobacco. In the long term, health-care costs savings could also reach $640.6 million.

As for the effects on Chicago’s consumers, Kilmer explained that a sales tax cut on Dec. 31 would save Cook County taxpayers $86 million in 2013. “It will be cheaper to buy groceries and baby formula,” Kilmer said. “Just not cigarettes.”

A U.S. appeals court ruled on Friday that cigarette companies do not need to comply with new federal rules requiring their products to show graphic warning images, such as of a man exhaling smoke through a hole in his throat.

The 2-1 decision by a court in Washington, D.C., contradicts a ruling in a similar case by another court in March, setting up the possibility that the U.S. Supreme Court will weigh in on the dispute.

People who smoke electronic cigarettes often don't think of it as smoking at all — the preferred term is "vaping," a reference to the small, battery-operated devices that heat nicotine into a vapor that's inhaled.
The gadgets, which have been on the market for four years, mimic the look of cigarettes, but because they contain no tobacco and far fewer chemicals are widely seen as safer. Yet as prices drop and more people are using them to quit smoking or circumvent smoke-free laws, new studies are questioning their use. Researchers say they may addict kids to nicotine or irritate bystanders with their vapor, but the industry says they do far more good than harm.
Young adults view the new nicotine-containing products positively and half say they'd try them if offered by a friend, particularly because they come in flavors, according to a University of Minnesota study published last month online in the American Journal of Public Health. Researchers interviewed 66 Americans, ages 18 to 26, about snus (a Swedish type of smokeless tobacco), dissolvable tobacco products and e-cigarettes, which come in bubble gum, cherry and chocolate flavors.
"There's a danger e-cigarettes could lure in kids who might not otherwise smoke," says anti-smoking activist John Banzhaf, a professor at the George Washington University Law School in Washington, D.C. He pushed for the Food and Drug Administration to regulate them.
The FDA, after finding trace amounts of toxic and carcinogenic ingredients in several samples, sought to regulate e-cigarettes as drug delivery devices. A federal judge ruled in 2010 that it lacked such authority, so the FDA is moving to regulate them as tobacco products.
"Many people use them as a bridge product" to avoid smoke-free laws — and as a result, they delay or avoid quitting, says David Abrams, executive director of the Shroeder Institute, operated by the anti-tobacco group Legacy. He co-authored a study in the same issue of the public health journal that found 70% of Americans believe e-cigarettes are less harmful than regular cigarettes.
A third peer-reviewed study found that e-cigarettes may emit aerosols, VOCs (volatile organic compounds) and nicotine, posing a "passive vaping" risk to bystanders. The study, by German researchers, appeared in July in Indoor Air.
Nonsense, an industry group says. "There's no smoke. It's water vapor. You don't smell anything," says Thomas Kiklas, director of the Tobacco Vapor Electronic Cigarette Association. "There's no there there" to the argument of harmful vapor, he says.
Kiklas says e-cigarettes contain only five ingredients: nicotine, water, glycerol, propylene glycol (used in inhalers) and flavorings. He says the samples FDA tested a few years ago had minuscule amounts of other ingredients, but the products have improved.
He says U.S. retailers try not to sell to kids, and he rebuffs the argument that sweet flavorings are meant to lure them, adding nicotine gum also comes in cherry. "Our demographic is 40 and above," he says.
"The amount of good we're doing is phenomenal," he adds, because the devices help thousands of people quit cigarettes. "The technology works. Smokers have embraced it."
Celebrities, so often trendsetters, have been seen vaping on screen. In The Tourist,Johnny Depp took puffs from a slim stick, saying, "It's not a real cigarette — it's electronic."
On the Late Show in 2010, actress Katherine Heigl whipped out her electronic cigarette, telling David Letterman it helped her stop smoking: "You're blowing out water vapor, so you're not harming anyone around you and you're not harming yourself.
Even some in the medical community see possible benefits: "E-cigarettes may hold promise as a smoking cessation method," concluded Michael Siegel of the Boston University School of Public Health in a study published in April 2011 in the American Journal of Preventive Medicine.
He and two co-researchers found that two-thirds, or 67%, of the 222 smokers queried said they smoked less after using e-cigarettes for six months and nearly a third, or 31%, said they kicked the tobacco habit.
Others are more skeptical. "We're not saying they're safe or unsafe. We just don't know. The responsible research needs to be done," Abrams says, adding that FDA-approved nicotine replacement devices have been thoroughly tested.
His Legacy colleague, pulmonologist Nathan Cobb, says there are quality control issues with e-cigarettes, almost all of which are imported from China. He says nicotine levels vary widely and contamination can occur with propylene glycol, which is used in a variety of products including inhalers and as an antifreeze.
"We're still trying to understand what happens when people inhale them," Cobb says. As for smoking cessation, he says, "Some e-cigarettes might be effective, some might not."
What's clear, though, is the upward trend in e-cigarette use and the downward spiral in its costs, now making it a less expensive alternative to cigarettes. Based on reports from factories and members of his organization, Kiklas expects U.S. sales this year of about 5 million, this for a product that first got on the market in 2008.
Each e-cigarette has three parts: battery, charger and cartridge, which contains the nicotine and other ingredients.
Each unit now sells for about $21, down from at least $200 three years ago, says Jerry Newton, owner of Earth N Ware in Orange County, Calif., which sells them and cigarettes. He says his replacement cartridges, which provide about as much nicotine as a pack and a half of cigarettes, cost $3 each.
Unlike cigarettes, these devices are not federally taxed, although some states are moving to impose their own taxes. An increasing number of cities and states are banning e-cigarette use in smoke-free places. Amtrak has banned its use on trains, and the Navy banned it below decks in submarines. In September, the U.S. Department of Transportation proposed a ban aboard airplanes because of concerns about health risks from the vapors.
Some who use them find them helpful. Newton, 63, says he was a chain smoker for 51 years despite repeated efforts to quit. On Aug. 16 last year, when he started using the electronic device, he took his last smoke from a real cigarette.
"My brain thinks it's still smoking," he says, referring to the nicotine effect he gets from e-cigarettes. "But my smokers' cough is gone. I feel a lot better."

Australian court OKs logo ban on cigarette packs

Australia's highest court upheld the world's toughest law on cigarette promotion on Wednesday despite protests from tobacco companies that argued the value of their trademarks will be destroyed under new rules that will strip all logos from cigarette packs.

 The decision by the High Court means that starting in December, tobaccocompanies will no longer be able to display their distinctive colors, brand designs and logos on cigarette packs. The packs will instead come in a uniformly drab shade of olive and feature graphic health warnings and images of cancer-riddled mouths, blinded eyeballs and sickly children. The government hopes the new packs will make smoking as unglamorous as possible.

"This is a victory for all those families who have lost someone to a tobacco-related illness. For anyone who has ever lost someone, this is for you," AttorneyGeneral Nicola Roxon and Health Minister Tanya Plibersek said in a joint statement. "No longer when a smoker pulls out a packet of cigarettes will that packet be a mobile billboard."

 Fears of global precedent

British American Tobacco, PhilipMorrisInternational, Imperial Tobacco and Japan Tobacco International are worried that the law will set a global precedent that could slash billions of dollars from the values of their brands. They challenged the new rules on the grounds that they violate intellectual property rights and devalue their trademarks.

 The cigarette makers argued that the government would unfairly benefit from the law by using cigarette packs as a platform to promote its own message, without compensating the tobacco companies. Australia's constitution says the government can only acquire the property of others on "just terms."

The court, which ordered the tobacco companies to pay the government's legal fees, withheld its reasons for the judgment on Wednesday. They'll be released later this year.

 British American Tobacco spokesman Scott McIntyre said the company was disappointed in the court's decision but would comply with the law.

Black market argument

"Although the (law) passed the constitutional test, it's still a bad law that will only benefit organized crime groups which sell illegal tobacco on our streets. ... The illegal cigarette black market will grow further when all packs look the same and are easier to copy," McIntyre said in a statement.

Imperial Tobacco echoed that argument.

 "Plain packaging will simply provide counterfeiters with a road map," Imperial Tobacco spokeswoman Sonia Stewart said in a statement. "The legislation will make the counterfeiters' job both cheaper and easier by mandating exactly how a pack must look."

Australia's health minister dismissed those claims, saying there are still measures to prevent counterfeiting, such as the use of alphanumeric codes on legitimate cigarette packs.

"There are all sorts of counterfeiting operations around the world," Plibersek told reporters. "The fact that this packaging looks like this now doesn't make it easier to counterfeit."

Jonathan Liberman, director of the McCabe Center for Law and Cancer, told reporters outside the court that the ruling would inspire other countries to take the same measures against tobacco companies.

 "It shows to everybody that the only way to deal with tobacco industry's claims, saber rattling and legal threats is to stare them down in court," he said.

"It's a fantastic decision for publichealth in Australia," he added.

 Australia faces a potential challenge to its laws through the World Trade Organization, with three tobacco growing countries — Ukraine, Honduras and the Dominican Republic — making official requests for consultation on plain packaging. Consultations are the first stage of the WTO's dispute resolution process.

These countries argue that the laws contravene Australia's international obligations in respect to trade-related aspects of intellectual property.

 Roxon said while countries had raised with Australia the trade implications of the laws, her government would fight to maintain them.

"It's never been asserted successfully around the world in any trade dispute that governments are not allowed to take public health measures to protect their community," she said.

 Tobacco advertising was banned from Australian television and radio in 1976. Restrictions on advertising have tightened over the years to include print ads, the Internet and retail outlets.

Smokers account for 17 percent of Australia's population, compared with around 20 percent of American adults.

With high taxes aimed at dissuading smokers, a pack of 25 cigarettes retails in Australia for about 16 Australian dollars ($17).

A National Youth Tobacco Survey study released Thursday reports a 1.4 percent decrease in smoking among high school students, from 17.2 percent in 2009 to 15.8 percent in 2011. Cigar use, on the other hand, appears to be on the rise.

The national health study by the Centers for Disease Control and Prevention was the third of its kind to detect a decline in adolescent smoking. It boasts participants from all 50 states and features 178 middle and high schools and 18,866 students. The survey measured usage over a 30-day period, and asked about all manners of tobacco products, including cigarettes, cigars, smokeless tobacco, pipes, bidis and kreteks, according to Education Week.

"An overall decline in tobacco use is good news, but although four out of five teens don't smoke, far too many kids start to smoke every day," Dr. Thomas Frieden, the Centers for Disease Control and Prevention director, said in a statement. "Most tobacco use begins and becomes established during adolescence."

Overall, the study found that cigar use among high school students increased from 10.9 percent to 11.6 percent, while smokeless tobacco use decreased from 22.2 percent to 21 percent. The rise in cigar use was particularly evident among black high school students, 11.7 percent of whom smoked cigars in 2011, compared to 7.1 percent in 2009.

Anti-smoking advocates attribute the upsurge in cigar smoking to lower tax rates on some styles, and the use of flavorings, according to the Winston-Salem Journal.

In March, the Surgeon General’s report indicated that in recent years, adolescent and young adult smoking of menthol cigarettes has increased significantly, while smoking non-mentholated cigarettes has been on the decline. According to the report, up to 58 percent of middle school smokers and 49 percent of high school smokers smoke menthol cigarettes.

Although smoking among high school students has declined since the 1994 Surgeon General’s report, the rate of decline has slowed in recent years.

In June, a government survey found that marijuana smoking has eclipsed cigarette smoking for the first time; while 23 percent of high school student indicated they had recently smoked marijuana, only 19 percent said the same about cigarettes.

CORRALES, N.M. (AP) - Corrales officials say a fire that burned more than 350 acres of the wooded area along the Rio Grande was most likely sparked by an electronic cigarette.

Village Administrator John Avila says an employee apparently dropped the device while patrolling on June 20.

The employee realized the device was gone after ducking under a tree limb.

The fire started soon after.

The employee tried to put out the flames, but Avila says the dry brush was quick to ignite. The fire ended up burning on both sides of the river.

Police say no charges will be filed because the cause was rule accidental.

Avila says the village is handing the case as a personnel matter.

He declined to release the employee's name. The village is now considering a new ordinance that would prohibit electronic cigarettes in the bosque.

While the city points to e-cigaretes as the culprit, eveyone isn't buying the story.

E-cigarettes can only be activated by puffing on the device or pushing a button, Stevie Vigil, Orchid Chamber Smoke Shop spokesman said.

"Our big selling point is that you can smoke them anywhere," Vigil said.

In its update, AP writes:

A Saudi Arabian teenager has been indicted on charges of interfering with a flight crew after authorities alleged he tried to hit fellow passengers, took a swing at a flight attendant and referred to Osama bin Laden during a flight to Houston.

Police arrested 19-year-old Yazeed Mohammed A. Abunayyan on Tuesday night at Portland International Airport after his Continental Airlines flight turned around after the incident.

A cousin said that his relative suffers from schizophrenia, was flying home to see his sick mother and hasn't taken his medication for three weeks.

The cousin, Fahad Alsubaie, 21, told the Medford Mail Tribune he was escorted off the plane with Abunayyan. Alsubaie said the disruption began after a flight attendant confronted the two for sitting together, because Alsubaie was in the wrong seat.

"I was going to ride back with him, just to make sure he was safe. They didn't want us to sit together," said Alsubaie, a Saudi Arabian exchange student studying English at Southern Oregon University in Ashland.

Wednesday's indictment said a flight attendant asked Abunayyan to stop smoking an electronic cigarette, but he refused. He's also accused of yelling profanities and swinging his fist at the flight attendant, and also hitting or attempting to hit several passengers.

Abunayyan also spoke or sang about Osama bin Laden and his hatred of women, the indictment said.

- UPDATE (7:26 p.m. ET on Wednesday, Feb. 22): Updated media reports suggest the disruption of Continental Flight 1118 may have had involved more than a simple altercation over an "e-cigarette."

KHOU TV of Houston reports passengers on the flight "said the unruly man was a problem from the beginning. After boarding Flight 1113, the man became upset because he was not seated next to his friend."

Passengers tell KHOU the man then began smoking an e-cigarette, later screaming at a flight attendant when she instructed him to stop.

The Oregonian also updates it story, identifying the man as 19-year-old Yazeed Mohammed Abunayyan of Saudi Arabia.

The newspaper adds court documents say Abunayyan is also accused of "yelling profanities and swinging his fist at the flight attendant, hitting or attempting to hit several passengers, and speaking or singing about Usama bin Laden and his hatred of women."

Eyewitnesses tell KHOU the man was subdued by passengers as he began to cause the ruckus.

"It almost made me cry to see the way everybody responded because the gentlemen that could help got up and helped the stewardess; she was just a little bitty thing," passenger Jeanna Wisher says to KHOU. "What happened should have happened, everybody got up and did a part that needed to do it."

The man was detained and questioned by federal authorities, who did not release his name. The Oregonian writes "Beth Anne Steele, an FBI spokeswoman in Portland, said he was held on a federal detainer pending formal charges, likely Wednesday morning."

The incident occurred Tuesday on (United) Continental Flight 1118, which was bound for Houston Bush Intercontinental. The man began smoking the "e-cigarette" sometime after takeoff.

"He was asked to not do that and was not cooperative," Port of Portland spokesman Steve Johnson says to the Oregonian.

The flight, which departed at 12:17 p.m. local time, returned to Portland at 1:17 p.m., where it was met by authorities. The man and a traveling companion were taken into custody.

E-cigarettes are currently not prohibited by the Transportation Security Administration, though the U.S. Department of Transportation has proposed a formal ban on them that could take effect as early as this spring, according to the Oregonian.

"Electronic cigarettes, or e-cigarettes, don't burn tobacco. The battery-operated devices offer users a vapor of liquid ingredients, including nicotine," USA TODAY writes in a September story about the DOT's proposed ban.

United Continental, however, tells the Oregonian it does not permit "the use of electronic, simulated smoking materials" of any kind on its flights.

The use of e-cigarettes among fliers has proved contentious in the past. In one recent example, a Southwest passenger allegedly pelted a flight attendant with peanuts after he was told he couldn't smoke his e-cigarette on a flight on that airline.

LOS ANGELES (AP) — Whitney Houston, who ruled as pop music's queen until her majestic voice and regal image were ravaged by drug use, erratic behavior and a tumultuous marriage to singer Bobby Brown, has died. She was 48.

Houston's publicist, Kristen Foster, said Saturday that the singer had died, but the cause and the location of her death were unknown.

News of Houston's death came on the eve of music's biggest night — the Grammy Awards. It's a showcase where she once reigned, and her death was sure to case a heavy pall on Sunday's ceremony. Houston's longtime mentor Clive Davis was to hold his annual concert and dinner Saturday; it was unclear if it was going to go forward.

At her peak, Houston the golden girl of the music industry. From the middle 1980s to the late 1990s, she was one of the world's best-selling artists. She wowed audiences with effortless, powerful, and peerless vocals that were rooted in the black church but made palatable to the masses with a pop sheen.

Her success carried her beyond music to movies, where she starred in hits like "The Bodyguard" and "Waiting to Exhale."

She had the he perfect voice, and the perfect image: a gorgeous singer who had sex appeal but was never overtly sexual, who maintained perfect poise.

She influenced a generation of younger singers, from Christina Aguilera to Mariah Carey, who when she first came out sounded so much like Houston that many thought it was Houston.

But by the end of her career, Houston became a stunning cautionary tale of the toll of drug use. Her album sales plummeted and the hits stopped coming; her once serene image was shattered by a wild demeanor and bizarre public appearances. She confessed to abusing cocaine, marijuana and pills, and her once pristine voice became raspy and hoarse, unable to hit the high notes as she had during her prime.

"The biggest devil is me. I'm either my best friend or my worst enemy," Houston told ABC's Diane Sawyer in an infamous 2002 interview with then-husband Brown by her side.

It was a tragic fall for a superstar who was one of the top-selling artists in pop music history, with more than 55 million records sold in the United States alone.

She seemed to be born into greatness. She was the daughter of gospel singer Cissy Houston, the cousin of 1960s pop diva Dionne Warwick and the goddaughter of Aretha Franklin.

Houston first started singing in the church as a child. In her teens, she sang backup for Chaka Khan, Jermaine Jackson and others, in addition to modeling. It was around that time when music mogul Clive Davis first heard Houston perform.

"The time that I first saw her singing in her mother's act in a club ... it was such a stunning impact," Davis told "Good Morning America."

"To hear this young girl breathe such fire into this song. I mean, it really sent the proverbial tingles up my spine," he added.

Before long, the rest of the country would feel it, too. Houston made her album debut in 1985 with "Whitney Houston," which sold millions and spawned hit after hit. "Saving All My Love for You" brought her her first Grammy, for best female pop vocal. "How Will I Know," ''You Give Good Love" and "The Greatest Love of All" also became hit singles.

Another multiplatinum album, "Whitney," came out in 1987 and included hits like "Where Do Broken Hearts Go" and "I Wanna Dance With Somebody."

The New York Times wrote that Houston "possesses one of her generation's most powerful gospel-trained voices, but she eschews many of the churchier mannerisms of her forerunners. She uses ornamental gospel phrasing only sparingly, and instead of projecting an earthy, tearful vulnerability, communicates cool self-assurance and strength, building pop ballads to majestic, sustained peaks of intensity."

Her decision not to follow the more soulful inflections of singers like Franklin drew criticism by some who saw her as playing down her black roots to go pop and reach white audiences. The criticism would become a constant refrain through much of her career. She was even booed during the "Soul Train Awards" in 1989.

"Sometimes it gets down to that, you know?" she told Katie Couric in 1996. "You're not black enough for them. I don't know. You're not R&B enough. You're very pop. The white audience has taken you away from them."

Some saw her 1992 marriage to former New Edition member and soul crooner Bobby Brown as an attempt to refute those critics. It seemed to be an odd union; she was seen as pop's pure princess while he had a bad-boy image, and already had children of his own. (The couple had a daughter, Bobbi Kristina, in 1993.) Over the years, he would be arrested several times, on charges ranging from DUI to failure to pay child support.

But Houston said their true personalities were not as far apart as people may have believed.

"When you love, you love. I mean, do you stop loving somebody because you have different images? You know, Bobby and I basically come from the same place," she told Rolling Stone in 1993. "You see somebody, and you deal with their image, that's their image. It's part of them, it's not the whole picture. I am not always in a sequined gown. I am nobody's angel. I can get down and dirty. I can get raunchy."

It would take several years, however, for the public to see that side of Houston. Her moving 1991 rendition of "The Star Spangled Banner" at the Super Bowl, amid the first Gulf War, set a new standard and once again reaffirmed her as America's sweetheart.

In 1992, she became a star in the acting world with "The Bodyguard." Despite mixed reviews, the story of a singer (Houston) guarded by a former Secret Service agent (Kevin Costner) was an international success.

It also gave her perhaps her most memorable hit: a searing, stunning rendition of Dolly Parton's "I Will Always Love You," which sat atop the charts for weeks. It was Grammy's record of the year and best female pop vocal, and the "Bodyguard" soundtrack was named album of the year.

She returned to the big screen in 1995-96 with "Waiting to Exhale" and "The Preacher's Wife." Both spawned soundtrack albums, and another hit studio album, "My Love Is Your Love," in 1998, brought her a Grammy for best female R&B vocal for the cut "It's Not Right But It's Okay."

But during these career and personal highs, Houston was using drugs. In an interview with Oprah Winfrey in 2010, she said by the time "The Preacher's Wife" was released, "(doing drugs) was an everyday thing. ... I would do my work, but after I did my work, for a whole year or two, it was every day. ... I wasn't happy by that point in time. I was losing myself."

In the interview, Houston blamed her rocky marriage to Brown, which included a charge of domestic abuse against Brown in 1993. They divorced in 2007.

Houston would go to rehab twice before she would declare herself drug-free to Winfrey in 2010. But in the interim, there were missed concert dates, a stop at an airport due to drugs, and public meltdowns.

She was so startlingly thin during a 2001 Michael Jackson tribute concert that rumors spread she had died the next day. Her crude behavior and jittery appearance on Brown's reality show, "Being Bobby Brown," was an example of her sad decline. Her Sawyer interview, where she declared "crack is whack," was often parodied. She dropped out of the spotlight for a few years.

Houston staged what seemed to be a successful comeback with the 2009 album "I Look To You." The album debuted on the top of the charts, and would eventually go platinum.

Things soon fell apart. A concert to promote the album on "Good Morning America" went awry as Houston's voice sounded ragged and off-key. She blamed an interview with Winfrey for straining her voice.

A world tour launched overseas, however, only confirmed suspicions that Houston had lost her treasured gift, as she failed to hit notes and left many fans unimpressed; some walked out. Canceled concert dates raised speculation that she may have been abusing drugs, but she denied those claims and said she was in great shape, blaming illness for cancellations.

SMMUSD HDQTRS — An old adage reads, "Where there's smoke, there's fire."

When it comes to an emerging trend in smoking, it's actually vapor that local educators in the Santa Monica-Malibu Unified School District are cracking down on.

The Board of Education added smokeless cigarettes, also known as e-cigarettes, to the list of prohibited products under its "tobacco-free schools" policy last week, joining several other state and federal agencies in banning the product.

The change means that students aged 18 or above and anybody else that uses district facilities are prohibited from "smoking" electronic cigarettes on school grounds.

A recent California law banned the sale of e-cigarettes to minors, but nothing prevented them from being used on school sites either by 18-year-old students nor adults that use the campuses for other things, like sports.

E-cigarettes are battery-powered devices formed of a cartridge that contains a nicotine solution and an atomizer which heats the solution until it forms a steam.

Users inhale the steam like smoke, and get a rush of nicotine similar to smoking a cigarette.

The things even look like cigarettes, to the point that some manufacturers put a red LED light at the end of them to simulate burning.

By expanding the policy to include the e-cigs and other "nicotine delivery devices," board members protected future money from competitive state grants called Tobacco-Use Prevention Education, or TUPE.

The district spent $26,000 in TUPE money in the 2009-10 school year, but the money dried up in recent years when the economy sunk down, said Chief Financial Officer Jan Maez.

That funding came from a 1988 initiative called Proposition 99 that added a tax on tobacco products that was used to fund research into the effects of tobacco and then educate students about them, said Greg Wolfe, spokesperson for the California Department of Education.

While laws to keep schools tobacco-free have been on the books for decades, the department has had to expand what fits under that definition.

"We don't want youth exposed to nicotine or tobacco use," Wolfe said.

So far, e-cigarettes don't seem to have found a huge following amongst young people, according to a random sampling of Santa Monica High School students.

"Kids are still experimenting with real cigarettes," said Joe Colajezzi, a senior at Samohi. "(Electronic cigarettes) are for adults because they recognize they have a problem and know it is a safe alternative that makes them feel like they are smoking."

Colajezzi tried an e-cigarette recently, and wasn't impressed.

"My dad was sitting on it, and I noticed it," he said. "I asked him why you don't just smoke a real cigarette?"

For one, the e-cigarettes have been sold as healthier because they don't involve burning, which introduces thousands of extra chemicals including carbon monoxide, which contributes to strokes and heart attacks.

People have long-accepted the health impacts of normal cigarettes, both on the smoker and the people around them, but the jury is still out on e-cigarettes.

The Federal Drug Administration, which first tried to regulate the product in 2008, found that the cartridges that carry the nicotine solution have cancer-causing and toxic chemicals in them, including diethylene glycol, an ingredient used in anti-freeze.

That could have an impact on bystanders downwind of the exhaled vapor, according to the FDA.

To date, there isn't much solid information about the impacts of e-cigarettes, but some feel it has to be better than the alternative.

Dr. David Baron, of Primary Caring in Santa Monica, approves of e-cigarettes as a healthful alternative for those that already smoke to the point that he acts as an unpaid medical advisor to one of the e-cigarette companies, Smokestik.

He still fully supports the school ban because "appearances matter."

"It's not because I think that it's going to harm them, but because it simulates a toxic behavior," Baron said. "On the chance that it leads a nonsmoker to smoke, that would be a darn shame. We don't want that."

Baron is also against the inclusion of flavors to e-cigarettes that could attract kids to smoke.

"They should be sternly criticized and frowned upon as targeting young buyers. That's very legitimate," Baron said. "Clearly if you are targeting that audience to use e-cigarettes if they aren't already smoking, that's definitely worthy of criticism and a reason to ban these things."

But for the average smoker, the e-cigarette could be a useful tool to health.

The addictive element in tobacco, nicotine, isn't inherently harmful, Baron said.

If it can be delivered to smokers without carcinogenic tobacco, as is already done with nicotine patches and gums, but in a form that satisfies other elements of the smoking addiction, all the better.

"If there was a study that compared it to gum or the patch, I think it would show that it's superior because it meets so many of the needs of the smoker," Baron said. "It gives them something to hold, place in the lips, breathe in and out, and nicotine."

Event sponsors will demonstrate and sell products at the event. Prizes will be given away all weekend. Smokers are admitted free when trading their cigarettes for an e-cigarette at the door.

Jason Cornfeld of Electronicstix.com, in Utah, said, "I can't wait to attend Vegas Vapefest. At previous Vapefests I've really enjoyed meeting customers who aren't close enough to visit our location in Ogden and hearing how they made the switch."

Carl V Phillips MPP PhD of TobaccoHarmReduction.org, attended Philly Vapefest in March and commented, "I am intrigued by the hobbyist aspect of the whole enterprise. There is an amazing collection of variant devices for vaping and an amazing knowledge base about how to make them and the 'juice,'" however, "I still fear for the current smokers who have never heard of vaping, or have been convinced by disinformation from the FDA and others that it is not a sensible alternative to smoking."

Contrary to FDA recommendations that electronic cigarette users should switch to FDA-approved smoking cessation products, new research published in the International Journal of Clinical Practice, conducted by J. Fouls, a professor at Penn State University, College of Medicine, Cancer Institute, confirms that the change could reverse the health gain achieved. Health risks associated with the use of e- cigs are likely much smaller (if any) than smoking traditional cigarettes and can potentially yield a large health benefit. Yet, the FDA and other anti-smoking organizations continue to adamantly claim electronic cigarettes are dangerous for your health. Electronic cigarettes are not FDA approved as smoking cessation products. The administration classified them as a tobacco product in April, 2011. Now, a growing number of survey-based evidence shows that e-cigs are being used successfully by smokers to quit smoking, the majority of which had previously tried FDA-approved nicotine replacement therapies (NRT) unsuccessfully. This is their primary motive for starting to use-ecigs, especially for long-time smokers. Perhaps more importantly, the reason why the e-cig appears to work so well for those desiring to quit is that it mimics cigarette smoking so closely while removing the hazards of inhaling smoke. In fact, findings reveal that a high proportion of e-cig users completely replace cigarette smoking with e-cig use—much higher than any FDA approved gums, patches and drugs.
Oddly enough, organizations such as the American Lung Association (ALA), the American Cancer Society (ACS) and the FDA, which stand to protect and promote health, are alleging risks associated with the use of electronic cigarettes without substantial evidence or research to back their claims. They assert that there is no scientific evidence about the safety of electronic cigarettes and that they are not a safe alternative to cigarettes. Yet, along with other independently published research, they recommend that smokers use FDA approved NRT’s which they deem acceptable permanent substitutes for smoking.

Nevertheless, even the highest daily dose of e-cig liquid contains the same amount of tobacco-specific nitrosamines (carcinogens) as a one-day supply of FDA-approved nicotine patch. Chantix initially dubbed a miracle drug, has such adverse effects including depression and suicidal thoughts that both the Department of Defense and the Federal Aviation Administration required that personnel operating aircrafts and/or missile crew members not take the drug. Furthermore, all FDA-approved NTR’s fail to compensate for an important physical element of cigarette-smoking, the hand-to-mouth gesture. Yet they continue to recommend them over other smokeless tobacco alternatives.

Public health experts need to provide truthful information about the relative risks of both FDA-approved NTR’s and electronic cigarettes. Warnings such as “there is no scientific evidence that e-cigarettes are safe or that they can help smokers quit” by the American Cancer Society are misleading half-truths. While no product could ever be 100% safe, warnings by the FDA, ALA and ACS amongst others, often imply that the health risks associated with the use e-cigs are potentially higher to the risks of smoking, which is far from the truth. In his study, Penn State Professor J. Foulds, states that “for those who have successfully switched to e-cigs, the priority should be staying off cigarettes” proving that recommending that ex-smokers who use electronic cigarettes switch back to FDA approved NTR’s could have devastating health consequences.

As explained by Michael B. Siegel is a professor of community health sciences at the Boston University School of Public Health “the distinct and unique advantage of e-cigarettes is that they allow individuals to utilize one device that can simultaneously address nicotine withdrawal, psychological factors, and behavioral cues that serve as barriers to smoking abstinence. The fınding that most individuals who used e-cigarettes at least reduced the number of tobacco cigarettes they smoked suggests that if proven safe, e-cigarettes may be a potentially important tool for harm reduction, especially among smokers who have found currently available pharmaceutical smoking-cessation options to be ineffective.”
